Exceptional Case Funding Merits Applications

From the Application Summary screen, select the Merits Assessment.

NOTE: All proceeding sections must have a status of complete before the means and merits assessments can be   accessed/completed.

A certificate type for an Exceptional Case cannot be specified (Emergency and Substantive). It is possible, however, to  indicate if the ECF   application is urgent   within the merits  assessment. 

If the case is marked as urgent, a reason for urgency will be required. 

Provide answers to the ECF Generic Information (example shown relates to family).

Questions based on Article 6 of the European  Convention of Human Rights will also be asked. This will include sections on right to legal aid, breach of clients rights, breach of Article 6  and other Convention rights. 

Once the merits assessment is complete, select the means assessment from the Application Summary screen.

The means assessment undertaken will be no different for ECF cases. 

NOTE: Once the application is completed and submitted, a document/evidence request will be sent to the primary contact. This must be processed before the LAA can process the application.
