Backdating powers – how to request

This guide is set out to provide instructions on how to request an application or an amendment to be backdated.

This guide is to provide instructions on how to request this via CCMS on your Legal Aid applications and amendments where you have urgent work to carry out before the LAA could make a determination and you have been unable to exercise your delegated functions.

Applications – When submitting an application in which you have urgent work to carry out and are unable to wait for the LAA’s determination, you will need to submit this via CCMS.

When you reach the Application Type question select the type as Emergency then click Next.

You will then complete the application as normal until you arrive at this question within the Merits Assessment.

Enter the reason for the urgent work, the date you wish to back date the application to and justification as to why the application should be backdated.

Continue the Merits Assessment and submit the application as normal.

Note: If you have submitted the an application but urgent work is required whilst the LAA determines the application you can submit a case enquiry at any time to request the LAA to consider backdating the application. You must provide a brief justification as to why the application should be backdated and include the nature of the urgent work and date.

If you require an amendment to a Legal Aid Certificate but you have carried
out urgent work as you believe the LAA would not have made a
determination in time, you should provide this information via a Document
Upload when the request is received.

When you submit an amendment to add a new scope limitation, CCMS will
automatically send a Document Request. If you do not receive a document
request, please contact our Customer Services Team on 0300 200 2020
who assist with providing the Document Request.

Click Documents Required to see the action information. The piece of work you have submitted will be processed once the required documents have been uploaded.

Click Add Electronic Document.

Choose an option from the Document Type drop down box. Enter a brief description of the document i.e. Backdating Justification

Click Browse to open your file management system and select your justification document

Click Next.

The uploaded document will appear in the Documents or Evidence Details table. Repeat the process to add more documents then click Submit to upload to CCMS.

POINTS TO NOTE: The Submission Confirmation screen confirms the documents have been attached to document request link. The documents are not yet received by the LAA. To send the documents to the LAA you must provide a notification response. If you don’t provide a response, your submission may be delayed.

Click Return to Notification.

Choose Documents Sent from the response drop down box. You can also enter a message to the LAA regarding information relating to the backdating of the amendment.

Click Submit.

Note: If you have submitted an amendment and not flagged the amendment to be backdated but you have had to complete urgent work whilst the amendment is pending, you can submit a case enquiry at any time to request the LAA to consider backdating the application. You must provide a brief justification as to why the application should be backdated and include the nature of the urgent work and date you wish the amendment to be backdated too.
