Part 1 ASBCPA Injunction Applications

This Quick Guide outlines the process for making Delegated Functions 

applications in relation to Part 1 ASBCPA proceedings. This process applies to Part 1 ASBCPA only and you should follow the usual Quick Guides for all other applications. 

The application should be submitted under the Residual category of law. 

The application type should be Emergency if you are using Delegated Functions. 

The next screen will not ask the date of delegated functions unlike other Emergency applications. 

In the Proceedings Details screen select the Matter Type Nuisance.

Choose the proceeding you require from the proceeding drop-down list.

Complete the rest of the application as normal until you get to the Merits Assessment section.

In the Merits Assessment you will be presented with the Emergency Details screen. 

Provide the date of Delegated Functions and the reason you have delegated in the section highlighted. 

NOTE: If you are not delegating on the application you will create a Substantive only application. 

If you have not recorded the date of Delegated Functions within the Merits Report the application will be dated from the date the application is granted by the LAA.
